Medicare and Medicaid Fraud Defense

We can assist you:

  • If you are a Medicare or Medicaid recipient
  • If you are a medical provider such as a doctor, pharmacist, or dentist
  • If you are representing a medical facility such as a clinic or hospital
  • If you are a durable medical equipment provider, home health care provider, or recruiter

Medicare or Medicaid fraud charges can arise if an individual or entity is suspected of providing false information on an application, receiving services without eligibility, fraudulent billing practices, fraudulently filing claims for fake services, overbilling, overprescribing, and other actions.

Medicaid and Medicare fraud charges are extremely serious, and are often investigated by the Office of Inspector General who has assigned investigators to the Department of Health and Hospitals. It is extremely important to act quickly and work with an attorney who has experience handling cases of this caliber. Whether you are under investigation for Medicare or Medicaid fraud — or if you have already been charged — we can review your case and help you identify an effective defense strategy.

If we can show that a client is not culpable, we can seek to prevent a prosecution altogether. If a client is culpable, we can minimize potential exposure and, in some cases, negotiate a civil penalty in lieu of prosecution. When a case is headed for trial, we take the time necessary to ensure that the case is adequately prepared.

New Focus on the Baton Rouge Area

The federal government has designated Baton Rouge as one of six areas for a special Medicare fraud task force. Special prosecutors from the Department of Justice in Washington D.C. are assigned these cases, looking to prosecute all involved for conspiring to commit health care fraud and violating "anti-kick back" statutes. Health care practitioners, DME providers and recruiters are all being targeted. Common prosecutions concern running and operating “health fairs” and placing “cold calls” to the elderly and selling the prescriptions to providers.

The Louisiana Attorney General’s office has a special Medicaid Fraud Division that works in conjunction with federal authorities in prosecuting health care providers and professionals for fraud. Common prosecutions concern billing for services not provided, double billing, and billing for services performed on an ineligible beneficiary.
